This Agreement applies when you subscribe to spotstr as a Professional. It adds to the Terms of Service (including the liability waiver, limitation of liability, protection of the Founders, arbitration and class-action waiver) and the Copyright & Intellectual Property Notice, which you also accept by subscribing.
2. Subscription
US$4.99 per month, billed in advance and renewing automatically until you cancel. Your bank or app store may convert the charge into your local currency. Applicable taxes may be added according to your country. You can cancel at any time from Profile → Subscription, and your listing stays active until the end of the paid period.
3. Your obligations
- Provide accurate identity, business and location information.
- Hold every license, permit, registration and insurance your profession requires in your country, and show it when we ask.
- Turn on Available Now only when you can actually accept clients, and keep published prices and offers honest.
- Respond to clients professionally, and follow consumer, health, safety, anti-discrimination and tax laws where you work.
- Upload only content you own or have permission to use.
- Submit only true, current and your own identity documents and license details, and update or remove a license that expires, is suspended or is revoked.
- Use a client's profile and messages only to handle that client's enquiry or booking. Do not copy, sell, publish or misuse client information.
4. Payments from clients
You collect payment from your clients directly through your own business process. spotstr does not handle, hold or guarantee those payments and is not responsible for them.
Booking deposits (optional). You may require clients to pay a deposit, of an amount you choose, to book you. To take deposits you must set up payouts with Stripe, spotstr’s payment processor. Payment processing services for Professionals on spotstr are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the “Stripe Services Agreement”). By setting up payouts, you agree to the Stripe Services Agreement, as it may be modified by Stripe from time to time. As a condition of spotstr enabling payment processing services through Stripe, you agree to provide spotstr accurate and complete information about you and your business, and you authorize spotstr to share it and transaction information related to your use of the payment processing services provided by Stripe.
Service fee. spotstr charges a service fee of 5% of each deposit, deducted automatically when the deposit is charged. Stripe’s card processing fees are also deducted from the deposit and paid by you. You receive the remainder through Stripe payouts to your bank account on Stripe’s payout schedule.
Holds, refunds and cancellations. Deposits for appointment requests are held on the client’s card and charged only when you accept; if you decline or do not respond within about 6 days, the hold is released. Instant-booking deposits are charged immediately. If you decline or cancel a booking after a deposit was charged, the client is refunded in full and spotstr’s fee is returned. Deposits are non-refundable to the client if they cancel or do not show up after you accepted, unless you choose to refund them or the law requires it. You are responsible for chargebacks and disputes on your payments and for any taxes on your income.
4A. Verification and badges
Identity verification for payouts is carried out automatically by Stripe. License details you submit are reviewed by spotstr staff. Badges are shown only as described in the Terms of Service (section 5A): they can be wrong, delayed or withdrawn, and spotstr, the Company and the Founders are not liable for errors in any check, for a check that rejects or delays you, or for clients' reliance on a badge. Submitting false documents or information leads to permanent removal.
5. SpotBoost and deal boosts
SpotBoost is bought for 1 to 12 hours, from US$2.99 for 1 hour to US$9.99 for 12 hours; the price for the hours you choose is shown before you pay. Boosted placements are labelled “Boosted · Sponsored”, and results are not guaranteed.
5A. Deals
You may have up to 2 active deals at a time for free. Each deal must be for a service you really offer, use your real normal price as the reference for any discount, and be honoured for bookings made while it is active, subject to your reasonable availability. Photos and videos must be your own work or used with permission and must follow the content rules (no nudity, sexual or violent content).
A deal boost costs US$2.99 and shows one deal more often in Find Deals for 24 hours. Boosted deals are labelled “Sponsored”, results are not guaranteed, and boosts are non-refundable once started, except where the law requires a refund.
spotstr may hold a deal for review, refuse it, end it early or remove it, and is not liable for lost bookings or visibility as a result, or for errors made by automated content scanning (see Terms of Service, sections 5A, 13A and 17A).
6. Removal
We may remove listings, reviews or content that break this Agreement or the law, or that put users at risk. Serious or repeated violations lead to termination without refund, except where a refund is required by law.
7. Responsibility for your services and conduct
You alone are responsible for the goods and services you provide, for their quality and safety, and for everything you say and do when dealing with clients, in the App, in messages or in person. spotstr is not your employer and, to the fullest extent permitted by law, bears no liability for your goods, services, actions or words.
To the extent permitted by law, you agree to indemnify Stepan Ikonnikov (spotstr) and its Founders against claims, losses and costs arising from your services, your conduct towards clients, or your breach of this Agreement or the law.
8. No copying
Being a subscriber gives you no right to copy, reproduce or imitate the spotstr app, its code, design, data or brand. Doing so is a breach of this Agreement and an infringement of the owners' intellectual property rights, and may lead to civil claims and, where local law provides, criminal prosecution.
